A condominium or homeowners association is established in advance of the first sale of a unit or home by the developer. At its point of establishment, the board of directors is appointed by the developer. The developer board operates the association until such time as either voluntarily or on a schedule mandated by statute the developer board resigns, and a board elected by the unit/lot owners is elected. That changeover of the makeup of the board is known as transition or turnover. In the Smart Board session, the firm’s lawyers will provide tips on how best to prepare the community for turnover, detail what is required of the developer at the time of transition, and outline what actions are appropriate during the crucial initial year post-transition to set the association on a positive course towards successful long-term operation.
